I. EXECUTION OF PAYMENT ORDERS
27. The Bank may refuse to execute or perform a payment order or another instruction, when:
(i) there is insufficient cover on Client’s account;
(ii) the payment order lacks the required completeness, mainly signatures or other identification codes on the payment order do not match the specimen signatures or other identification codes on file with the Bank;
(iii) the payment might violate applicable law.
28. Authorization for a Client's accounts without his agreement is permissible only in cases of corrections permitted by law or an agreement in which the Client authorizes the Bank to such act.
29. If the Bank is given various instructions and orders by Client, the total
amount of which exceeds the available assets or credit limits granted, the Bank
shall be entitled to determine at its own discretion which instructions or
orders should be executed, regardless of the date they bear or have been
received on. In the case of non sufficient cover on Client’s current account,
the Bank shall execute a payment order, when the Client will provide a
sufficient cover on its current account within 5 working days from a payment
order issuing. Otherwise original payment order shall be considered as invalid
and the client shall submit to the Bank a new payment order.
30. The Bank may, instead of the standard methods used by the Client, accept any payment order, notice or instruction of the Client specified in these Terms and Conditions or according to these Terms and Conditions, respectively accordingly to the Terms and Conditions for Electronic Banking System.
31. The Bank is entitled to refuse to credit any funds, where suspicion exists they originate from criminal activities. The Bank shall not allow disposal of the funds on the account if it receives a court order, based on the decision of a competent authority in penal proceedings or a court, or any other authority entitled by law to act in such matter. The Bank has the exclusive right to prohibit the disposal of funds in the account if the Bank has any suspicion of criminal activity concerning the funds deposited in the account, further, in such case, the Bank has the right to terminate the legal relationship with the Client.
